Schutzmaßnahmen und urheberrechtlichen Schranken bestehende Spannungsverhältnis näher zu beleuchten und generelle Lösungsmöglichkeiten für dieses Kollisionsproblem aufzuzeigen. Einen Schwerpunkt bilden die dbzgl Bestimmungen der UrheberrechtsRL und deren Umsetzung im öUrhG im Rahmen der Novelle 2003. Dem geht zunächst eine Darstellung des Vervielfältigungsrechts sowie der durch die UrheberrechtsRL bedingten Änderungen desselben voraus. Im Anschluss daran wird die gesetzliche Lizenz der Vervielfältigung zum eigenen bzw. privaten Gebrauch dargestellt. Ausführlich behandelt werden v.a. die durch die ComputerprogrammRL, DatenbankRL und insbes. die UrheberrechtsRL bedingten Einschränkungen der Privatkopieschranke. Dabei wird insbes. geklärt, ob § 42 UrhG auch die Herstellung digitaler Kopien zum eigenen Gebrauch abdeckt und welche Änderungen sich in diesem Bereich durch die UrheberrechtsRL insbes. durch den Drei-Stufen-Test, ergeben haben. Ausführlich untersucht wird dabei, ob auch der Download von Musikstücken aus Tauschbörsen unter das Privileg der gesetzl. Lizenz der Vervielfältigung zum privaten Gebrauch gemäß § 42 UrhG fällt und mithin rechtmäßig ist. Es folgt eine Untersuchung der Zulässigkeit des Einsatzes techn. Schutzmaßnahmen unter urheberrechtl. Aspekten, wobei zwischen zugangsverhindernden und nutzungsverhindernden Schutzmaßnahmen unterschieden wird. Dabei wird auch die Frage behandelt, ob sich die freie Werknutzung der Vervielfältigung zum privaten Gebrauch als Recht darstellt, aus dem sich ein Anspruch der Nutzer auf die Herstellung von Privatkopien ableiten ließe. Diesen Ausführungen schließt sich eine Untersuchung der Zulässigkeit nutzungsverhindernder Schutzmaßnahmen unter gewährleistungsrechtlichen Gesichtspunkten an. In weiterer Folge werden die Bestimmungen der UrheberrechtsRL über den Schutz technischer Maßnahmen vor Umgehung sowie deren Umsetzung im UrhG umfassend behandelt. Neben den neu eingeführten Regelungen wird dabei ebenso auf den schon bisher bestehenden Umgehungsschutz für technische Vorkehrungen nach § 1 UWG sowie auf die gesonderten Umgehungsschutzbestimmungen für Computerprogramme und Zugangskontrollen eingegangen. Den Abschluss bildet das Kernstück der Arbeit, in welchem das zwischen techn. Schutzmaßnahmen und der Privatkopieschranke bestehende Kollisionsproblem aufgezeigt und grundsätzliche Lösungsmöglichkeiten sowie die vom europ. Gesetzgeber gewählte Regelungsoption dargestellt werden.

In 1983, the California Network of Mental Health Clients (CNMHC). a network of mental health clients throughout California was formed. At it's first organizing meeting it established a Self-Help Task Force to encourage, support and assist in the formation and in the development of self-help groups throughout California. This task force wrote an Action Plan describing how it would accomplish it's vision. In this Action Plan was the goal to create, publish and distribute a manual on how to start and run a mental health self-help group. Some of the well-known activists who contributed to the production of this manual, far too many too mention by name, include Leonard Roy Frank, Judi Chamberlin, Howie the Harp, Sally Zinman and Joe Rogers. Through their unwavering commitment this manual was published in 1987 and became an instant classic within the mental health community throughout the United States.
